Who Is Eligible To Join The LawsuitsAny employee working for the City and County of Honolulu is eligible to join the lawsuit provided that the employee was not a plaintiff in the first FLSA lawsuit against the City. The first lawsuit was known as Smith v. City and County of Honolulu, and concluded with a settlement in 2006. You must have been an employee of the City at some time after December 15, 2004 to be eligible to join the lawsuit. FLSA lawsuits are different than regular class actions in one important way — to be covered by the lawsuit, an employee must take steps to affirmatively join the lawsuit through filing a document with the court known as a "Consent To Join." Employees who do not file Consents To Join are not bound by the lawsuit, and receive none of the damages awarded either through a verdict or through a settlement. |
